Many foreclosure cases have been filed improperly. We assist our clients with the identification and filing of substantive defense with the court. In doing so, we attempt to delay the foreclosure process and/or stop it completely. By delaying your foreclosure action we make it possible for you to stay in your home for up to a year without making payments. Furthermore, it gives you time to explore alternatives, such as:
-
-Negotiate a Loan Modification with the bank
-
-Sell your home for a fair price
-
-Refinance your home at a fair rate
-
-Stay in your home without making payments
-
-Continue to collect rent on your property
-
-Apply for a Court Ordered repayment plan
-
-File a Chapter 13 or 7 Bankruptcy
Deed-in-Lieu of Foreclosure
Deed in Lieu (DIL) of Foreclosure is another available option whereby the property may be deeded directly to the Lender avoiding a foreclosure on your credit. DIL can be the best option when foreclosure is unavoidable and the borrower is unable to sell the property. Lender acceptance is required and the property must be free and clear of other liens and in good condition.
